Application to Become a Class Action to be heard in February 2026
Class action application
On 26 September 2025 the Limery plaintiffs applied to the Napier High Court for the current High Court proceeding in CIV 2024-441-00053 against the Hawkes Bay Regional Council (HBRC) to become a class action for the benefit of all Wairoa people that suffered loss in the floods on 26 June 2024. Copies of the application and affidavit are in the documents tab on the website. The HBRC is to file/serve any documents in opposition to the application by 28 November 2025. The Court will then have a hearing on 3 February 2026 in Napier.
Early evidence hearing
In the court proceedings about the Wairoa river bar and its management, the evidence from a person involved in the management of the bar over many years will be extremely important. Robert Cram was involved in bar management for about 34 years until 1989. He Is now 92 years old. So, the plaintiffs have asked the High Court to hear Mr Cram’s evidence now. On the website is a copy of the application and Mr Cram’s affidavit. On 1 December 2025 the Napier High Court will take the evidence on video.
